II. Information We Collect

Throughout this Privacy Policy, we use the term “personal information” to describe data that identifies you or makes you identifiable. What constitutes personal information depends on the local laws based on your residence, but generally refers to any information, alone or in combination with other data, that could reasonably identify an individual. Only the definition that applies under your local law will apply to you under this Privacy Policy. The types of personal information that we may collect about you include, but are not limited to:

a. Information You Voluntarily Provide to Us.

Waitlist Signup: contact information such as your name, phone number, and email address;

Valuables and Insurance Policy Information: contact information, date of birth, marital status, family/dependent information, and details about insured watches, including appraisals, valuations, policy coverage, claims history, and quotes;

Payment Information: billing address, payment method, and other financial details needed to process transactions;

User-Generated Content: information you provide through reviews, comments, or other forms of interaction;

Account Setup Information: contact information, username, authentication credentials.

Customer Service: contact information and messages we receive through our Customer Service team when you have questions or issues with our Services, or otherwise communicate with us by email, our Website, by telephone, in writing, or through other means; and

Job application data: such as education and professional qualifications.

Please note: When communicating with us by email or through forms on our Services, we ask that you please do not send us any sensitive information pertaining to yourself. WonderCare does not collect or store sensitive information or special categories of information.

b. Information from Third Parties.

When you interact with our Services or accounts on a social media platform, we may collect the personal information that you or the platform make available to us on that page or account, including your social media account ID and/or user name associated with that social media service, your profile picture, email address, friends list or information about the people and groups you are connected to and how you interact with them, and any information you have made public in connection with that social media service.

c. Information We Collect Automatically.

As you navigate through and interact with our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

Information About Your Use of the Services: when you browse our Website, our systems automatically collect information such as your web request, Internet Protocol (“IP”) address, browser type, browser language, domain names, referring and exit pages, and URLs, platform type, pages viewed and the order of these page views, the amount of time spent on particular pages, and the date and time of your request.

Performance Data: we may collect information about your preferences to make your use of the Services more productive. For more information, please see the “Cookies and Other Tracking Technologies” section below.

III. How We Use Your Information

We will only use your personal information as described in this Privacy Policy or as disclosed to you prior to such processing taking place. The purposes for which we may use your personal information include:

a. To Provide You With Our Services.

We may use your personal information to provide you with information or to deliver our Services and any related products, to analyze and administer claims and for any other business or lawful purpose reasonably anticipated within the context of WonderCare’s relationship with you.

b. To Provide Service-Related Communications.

We may send you administrative information to keep you updated about our Services. Such communications may include information about changes to this Privacy Policy, our Terms, security updates, and tips or other relevant information. Service-related communications are not promotional in nature. You are not able to unsubscribe from such communications, as you may miss important developments relating to our Services.

c. To Provide Customer Support.

We will use your personal information to respond to your Customer Service inquiries, investigate any complaints, and ensure your continued use and enjoyment of the Services.

d. To Send You Marketing and Promotional Emails.

We may contact you with marketing or promotional materials and other information that may be of interest to you based on the Services that you already use or the offerings about which you have already purchased or inquired. You may opt out of receiving such emails using a link at the bottom of any marketing email or by contacting us as described below.

e. For Product Research and Development.

We want to ensure our Services are continually improving and expanding so that we meet and exceed your needs and expectations. To do so, we may process your personal information to improve, optimize, or expand our Services or features of our Services. We do so by processing information about your use of the Services as well as any information you provide to us, and by measuring, tracking, and analyzing trends and usage in connection to your use or the performance of our Services. Without processing your information for such purposes, we may not be able to ensure your continued satisfaction when using our Services.

f. To Enable Our Service Providers.

We use personal information to enable other companies and individuals acting on our behalf to facilitate our Services (“Service Providers”) to provide services to us so that we can provide our products and Services to you, or for other business purposes consistent with WonderCare’s relationship with you.

g. To Enforce Compliance with Our Agreements or Policies.

We process your personal information in accordance with this Privacy Policy to combat spam, malware, malicious activities, fraud, or security risks, as part of our ongoing maintenance and enforcement of our security measures, and to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection.

h. To Maintain Legal and Regulatory Compliance.

We process personal information to pay our taxes, fulfill our business obligations, ensure compliance with employment and recruitment laws, in response to valid warrants and legal processes, or as necessary to manage risk under applicable law.

i. For Customization.

We process personal information in connection with saving your user account, registration, and profile data or other personal information on our Services (so you do not have to re-enter it each time you visit or use the Services); tracking your return visits to and use of the services; tailoring your experience on the Services; and/or otherwise customizing what you see when you visit and use the Services;

We may process any information regarding your account and your use of our Services as is necessary in the context of corporate acquisitions, mergers, bankruptcy, dissolution or other corporate transactions.

IV. Sharing and Disclosure of Information

We may disclose your personal information in the following circumstances:

a. Within Our Corporate Organization.

WonderCare is part of a corporate organization that has several legal entities, business processes, management structures, and technical systems. We may share your personal information with any of our corporate affiliates, including but not limited to companies controlled by or under common control with WonderCare, in order to provide you with the Services and take actions based on your request, as well as for the purpose of management, analysis, and business maintenance. For example, we may share your information with our affiliated companies to process orders and requests or expand and promote our Services.

b. Service Providers.

We may employ Service Providers to provide the Services on our behalf, perform service-related activities or assist us in analyzing how our Services are used. These Service Providers may provide us with support services such as credit card processing, website hosting, email, and postal delivery, analytics, and marketing services or conducting research. The Service Providers have access to your personal information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

c. Corporate Transactions.

We may disclose personal information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or sale or transfer of some or all of our assets, whether as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by us about the users of our Services is among the assets transferred. You agree to and do hereby consent to our assignment or transfer of rights to your personal information in such circumstances.

d. To Maintain Legal and Regulatory Compliance.

WonderCare also may disclose your personal information to another party, such as law enforcement officials, to comply with legal requirements, court orders, government or law enforcement agency requests, to protect or defend WonderCare, or where we perceive an immediate danger of death or serious physical injury to someone as a result of activity on our Services. Our disclosures may occur under circumstances where we may not be authorized to advise you of such action.

e. Third Party Partners

We may share information with third party partners, including insurers, brokers, underwriters, medical service providers, fraud detection agencies, legal, accounting and claims handling professionals, and similar insurance industry related entities. We do not share your personal data with these third parties for sales or marketing purposes.

f. With Your Consent.

We may disclose your personal information for any purpose with your consent.

V. Cookies and Other Tracking Technologies

We may use cookies, embedded scripts, software development kits (“SDKs”) and other similar technologies (collectively, “Tracking Technologies”) to collect additional personal information automatically as you interact with the Services and to personalize your experience with our Services.

a. Cookies.

Cookies are small web files that a website or its provider transfers to your device’s hard drive through your web browser that enables the website’s or provider’s system to recognize your browser and remember certain information. “First-party cookies” are cookies which are served the entity operating the domain through which the cookie is served. WonderCare and our affiliates’ own cookies are therefore “first-party cookies.” In case we allow others to service cookies through our Services, these cookies are called “third-party cookies.” We use first-party and third-party cookies for the following purposes:

to make our Services function properly;

to improve our Services;

to make login to our Services easier (such as by remembering your user ID);

b. Analytics.

We may use third-party service providers, including Google Analytics, to monitor and analyze the use of our Website. Google Analytics is a web analytics service offered by Google LLC (“Google”) that tracks and reports Website traffic. We use conversion beacons, tags, scripts, and pixels (each a “Tracking Technology” and collectively, “Tracking Technologies”), which fire a short line of code to tell us when you have clicked on a particular button or reached a particular page. We also use these Tracking Technologies to analyze usage patterns of our Services and record that a particular device, browser, or application has visited a particular webpage.

d. Your Choices.

Your browser may provide you with the option to refuse some or all browser Tracking Technology. You can exercise your preferences in relation to Tracking Technology served on our Website by taking the steps outlined below.

First-Party Cookies. You can use your browser to enable, disable or delete cookies. To do this, follow the instructions provided by your browser (usually located within the “Help”, “Tools” or “Edit” settings). e. Do Not Track.

Some Internet browsers, such as Internet Explorer, Firefox, and Safari, include the ability to transmit “Do Not Track” or “DNT” signals. However, uniform standards for “DNT” signals have not been adopted, so our Website does not currently process or respond to “DNT” signals.

We take commercially reasonable precautions intended to protect personal information under our control from misuse, loss or alteration. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such information, nor can we guarantee that the information you supply will not be intercepted while being transmitted over the internet. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Services.

The safety and security of your information also depends on you. Where we have given you (or where you have chosen) account credentials or a password for access to certain parts of our Services, you are responsible for keeping this account information confidential. You should not share your account information with anyone.

VII. Social Media Pages

Please note that we are not responsible for the collection, usage and disclosure policies and practices (including data security) of other organizations, such as Facebook, Apple, Google, Microsoft, X or any other social media platform provider, operating system provider, wireless service provider or device manufacturer, including any personal information you disclose to other organizations through or in connection with our social media pages. Any posts you make on our social media pages may be available to others who use those pages. Never include sensitive personal, financial, or other confidential information such as your social security number, address, phone number or email address when posting or commenting online. Please refer to the privacy policies of our social media partners when you interact with them online.

VIII. Artificial Intelligence

We or our service providers may use artificial intelligence (AI) to provide products or services to you, which may involve the use of your Personal Information from the Sources described herein. We may use AI in connection with our products or services to facilitate and service our business (e.g., assist in underwriting, pricing, claims handling process or data management), as well as to enhance performance and user experience on our websites and applications. The type of AI we use varies based on your relationship with us and by product and service.

IX. Children

Our Services are not directed to children under the age of 18. We do not knowingly collect personal information from any child under the age of 18. If you become aware that a child under 18 has provided us with personal information, please contact us and we will take steps to delete such information from our systems.

X. Retention

We will retain your information for as long as your account is active, as needed to provide you Services or for other purposes stated in this Policy. We will delete the personal data or remove how the personal data can be associated with you as required by applicable law. To cancel your account or request that we no longer use your information to provide you services, please contact us via the method identified in the “Contact Us” section below. We may still retain and use your information as necessary to comply with our legal obligations, resolve disputes, enforce our agreements and as otherwise permitted by law.

XI. Your Privacy Choices

a. Choices

We offer you certain choices about how we use your information and communicate with you.

Access or Update Your Information. If you have created a user account through the Services, you will be able to access, update and correct the personal data you have provided in connection with your account by logging into your account through the Services. You may also notify us via the information in the “Contact Us” section below to correct or update any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

Delete Your Information. Under certain circumstances, you may be able to request that we delete the personal information that we hold about you. This right is not absolute, and we may refuse such a request if there are compelling legitimate grounds for keeping your personal information, for legitimate purposes, or as required by law. In addition, in the event your deletion request is honored, we may retain a record of your deletion request as required under applicable laws and their exceptions.

b. Submitting a Request to Exercise Your Privacy Choices

To assert your privacy choices noted above, you may submit your request via the information in the “Contact Us” section below.

To protect your privacy, we must be able to verify your identity to confirm that the request came from you before we can process your request to exercise any of the privacy rights that you may be entitled to under the applicable law. We may contact you by phone or e-mail to verify your request. Depending on your request, we will ask for information such as your name, an e-mail address, or a phone number you have used with us.

XII. California Consumer Privacy Notice at Collection

If you are a California resident, this section applies to you in addition to the rest of this Privacy Policy.

Categories of Personal Data Collected, Used, and Disclosed

In the preceding 12 months, depending how you interact with our Services, we may have collected the following categories of personal information (as defined under Cal. Civ. Code §1798.140(v)(1)):

Identifiers, such as real name, alias, job title, address, email address, date of birth, policy number, salary information, social security number, driver’s license number, other government identifiers, credit card number, and tax ID.

Online Identifiers, such as unique personal identifiers, device IDs, ad IDs, IP addresses, and cookie data.

Customer or Claimant Records, such as paper or electronic customer or claimant records containing Personal Information, as well as information provided by an insurance broker/agent or reinsurer for underwriting purposes and information included in a list of claims, such as name, signature, physical characteristics or description, address, telephone number, education, current employment, employment history, social security number, passport number, driver’s license or state identification card number, insurance policy number, bank account number, payment card number, gender, height, weight, medical information (including reports and medical bills), health insurance information, details about home address, security and travel plan arrangements, records of personal property, products or services purchased or obtained.

Financial Information, such as your bank account or credit card number and other payment details.

Characteristics of Protected Classifications under California or Federal Law, such as age (40 years or older), race, ancestry, national origin, citizenship, religion or creed, marital status, pregnancy, medical condition, physical or mental disability, sex, sexual orientation, and veteran or military status.

Usage Data, such as Internet or other electronic network activity information regarding a California resident’s interaction with portals, Internet websites, applications, or advertisements, including, but not limited to, browsing history, clickstream data, search history and content of public posts.

Biometric Information, such as individual biological or behavioral characteristics including measurements of physical characteristics such as height, weight and blood pressure, sleep, health, or exercise data that contain identifying information.

Education Information, such as education records directly related to a student maintained by an educational institution or party acting on its behalf, such as grades, transcripts, class lists, student schedules, student identification codes and student disciplinary records.

Geolocation Data, such as physical location or movements.

Audio, Video and Other Electronic Data, such as audio information including call recordings, video and photographs, recorded meetings and webinars, and CCTV footage to secure our offices and premises.

Professional or Employment-Related Information, such as employment history, qualifications, licensing, and disciplinary record.

Inferences and Preferences, such as inferences drawn from any of the information described in this section about a consumer including inferences reflecting the consumer’s preferences, characteristics, behavior and abilities.

Sensitive Personal Information, such as social security number, driver’s license number, racial or ethnic origin, citizenship or immigration status, religious or philosophical beliefs, medical condition, and physical or mental disability.

We generally collect personal information from the following categories of sources:

Directly from you and automatically;

Our affiliates and subsidiaries;

Brokers and agents;

Corporate policyholders; and

Our vendors and service providers (e.g., third party administrators).

Purposes for Collecting and Using Categories of Personal Data

In general, we collect and otherwise process the personal information we collect for the following business or commercial purposes:

Operate our business;

Provide you products and services;

Communicate with you;

Evaluate and improve our products and services;

Analytics models to support our business;

Marketing and advertising;

Inferences;

Find locations on request;

Fraud and security purposes;

Legal requirements;

Business transfers; and

Other operational and business purposes.

The categories of third parties and other recipients to whom we may disclose personal information for a business purpose may include:

Reinsurers;

Additionally, the CCPA defines “sale” as disclosing or making available personal information to a third-party in exchange for monetary or other valuable consideration, and “sharing” includes disclosing or making available personal information to a third-party for purposes of cross-contextual behavioral advertising. While we do not “sell” Personal Information, we may “share” the following categories of Personal Information: online identifiers, and usage data. We disclose this information to third-party advertising networks, analytics providers, and social networks for purposes of marketing and advertising. We do not sell or share “sensitive personal information,” nor do we sell or share any Personal Information about individuals who we know are under sixteen (16) years old.

Sensitive Personal Information

Notwithstanding the purposes described above, we do not collect, use, or disclose “sensitive personal information” beyond the purposes authorized by the CCPA. Accordingly, we only use and disclose sensitive personal information as reasonably necessary and proportionate: (i) to perform our services requested by you; (ii) to help ensure security and integrity, including to prevent, detect, and investigate security incidents; (iii) to detect, prevent and respond to malicious, fraudulent, deceptive, or illegal conduct; (iv) to verify or maintain the quality and safety of our services; (v) for compliance with our legal obligations; (vi) to our service providers who perform services on our behalf; and (vii) for purposes other than inferring characteristics about you.

XII. California Privacy Rights

Under California law, if you are a California resident you may assert certain rights identified below with respect to your personal information.

Please note, your rights in relation to your personal data are not absolute and may be denied in certain cases, including but not limited to: (i) when denial of the request is required or authorized by law; (ii) when granting the request would have a negative impact on another’s privacy; (iii) to protect our rights and properties; (iv) where the request is frivolous or vexatious, or for other legally permissible reasons.

Your California privacy rights include:

Right to Know/Access. You may have the right to obtain a copy, or a list of categories of the personal data that we hold about you.

Right to Correct/Rectification. You may have the right to correct any of your personal data in our records and systems that you provided to us and that has become inaccurate.

Right to Delete/Erasure. Under certain circumstances, you may have the right to request that we delete the personal data that we hold about you. This right is not absolute, and we may refuse your right to delete under certain circumstances, for which we would provide an explanation.

Right to Portability. Under certain circumstances, you may have the right to receive personal data we hold about you in a structured, commonly used, and machine-readable format so that you can provide that personal data to another entity.

Right to Object to Automated Decision-Making. You may have the right not to be subject to a decision that is based on automated processing. We do not make any decisions about you solely on the basis of automated decision making.

Your Right to Limit Use of Sensitive Information

If you are a California resident, to the extent your sensitive personal information (as that term is defined under the CCPA) is used to infer characteristic about you, you have the right to direct us to stop such processing of your sensitive personal data for such purposes. We do not process any sensitive personal information to infer characteristics about you without your consent.

Exercising Your Rights

If you are a California resident and would like to exercise your CCPA rights, you may do so via any of the methods described below:

To protect your privacy, we must be able to verify your identity to confirm that the request came from you before we can process your request to exercise any of the privacy rights that you may be entitled to under the applicable law. We may contact you by phone or e-mail to verify your request. Depending on your request, we will ask for information such as your name, an e-mail address, or a phone number you have used with us.

You may designate someone as an authorized agent to submit requests and act on your behalf. Authorized agents will be required to provide proof of their authorization in their first communication with us, and we may also require that you directly verify your identity and the authority of your authorized agent.

Shine the Light

You have the right to ask us for a notice describing what categories of personal information we share with third parties or corporate affiliates for those third parties’ or corporate affiliates’ direct marketing purposes. That notice will identify the categories of personal data shared with third parties and used for direct marketing purposes and the name and address of the third parties that received such personal data.

International Transfers of Data

WonderCare is headquartered in the United States and is subject to US law. Please be advised that the provision of our services may require the transfer of your personal information across international borders to the United States or to other countries where the privacy laws may not be as protective as those in your jurisdiction. In the event of such a transfer, we will follow any and all applicable data protection laws to ensure the protection and safeguarding of your personal information.

We will take commercially reasonable steps to ensure that your personal data is treated securely and in accordance with this Privacy Policy and no transfer of your personal data will take place to an organization or country unless there are appropriate safeguards in place as required under the applicable data protection laws and ensuring the security of your personal information is maintained. If you choose to use our Services while located outside the United States, you hereby irrevocably and unconditionally consent to such transfer, processing, and use of your information in the United States and elsewhere. If you do not wish for your information to be transferred to, processed, or maintained outside of the country or jurisdiction where you are located, you should immediately cease accessing our Services.

This section only applies to individuals using or accessing our Service while located in the European Economic Area, the United Kingdom, or Switzerland (collectively, the “European Countries”) at the time of data collection pursuant to the European Union’s General Data Protection Regulation, the UK General Data Protection Regulation, or the Swiss Data Protection Act (collectively, the “GDPR”).
